The expression “upper hand” comes from America’s once-favorite pastime, baseball. To decide which team would bat first in a sandlot baseball game, one player would grab a baseball bat at its base. A player from the other team would then place his hand above the first player's hand. Up the bat they would go, each gripping the bat until they reached the top. The player with the topmost hand would then have the "upper hand,” with the choice of batting first.
